Bienvenido a SMCUBA. Al acceder o utilizar nuestros servicios, aceptas quedar vinculado por estos Términos y condiciones. Por favor, léelos detenidamente antes de realizar cualquier operación.

1. Definiciones

«SMCUBA» o «Plataforma»: el sitio web smcuba.com y todos los servicios asociados operados por SMCUBA LLC.

«Usuario»: cualquier persona física o jurídica que accede a la Plataforma y/o contrata los servicios.

«Recarga»: la transferencia de saldo, minutos o datos a un número de teléfono o cuenta Nauta en Cuba.

2. Objeto del servicio

SMCUBA facilita la contratación de recargas telefónicas (Cubacel) y de internet (Nauta) para números y cuentas ubicados en Cuba, en nombre y por encargo del Usuario.

3. Registro y seguridad de la cuenta

• El Usuario debe proporcionar información veraz, completa y actualizada durante el registro.
• Es responsabilidad del Usuario mantener la confidencialidad de sus credenciales de acceso.
• SMCUBA no se hace responsable de accesos no autorizados derivados de la negligencia del Usuario en la protección de su contraseña.

4. Tarifas y pagos

Los precios se muestran en dólares estadounidenses (USD) e incluyen todos los cargos aplicables. SMCUBA se reserva el derecho de modificar las tarifas en cualquier momento, siendo efectivos los cambios desde su publicación en la Plataforma.

El pago se realiza mediante los métodos aceptados en la Plataforma (Visa, Mastercard, American Express, PayPal). El cargo se realiza en el momento de confirmar el pedido.

5. Entrega del servicio

Las recargas se procesan de forma automática. El tiempo estimado de entrega es inferior a 60 segundos bajo condiciones normales de operación. SMCUBA no garantiza tiempos de entrega cuando la demora sea imputable a los operadores cubanos (Cubacel / ETECSA).

6. Política de reembolsos

• Una vez procesada la recarga con éxito, no se admiten cancelaciones ni reembolsos.
• Si la recarga no llegó al destino por causas imputables a SMCUBA (error técnico, doble cobro, etc.), se efectuará el reembolso completo en un plazo máximo de 5 días hábiles.
• Para solicitar un reembolso, contacta a support@smcuba.com con el número de pedido.

7. Uso aceptable

Queda prohibido el uso de la Plataforma para:

• Actividades fraudulentas o ilegales.
• Introducir información falsa o suplantar la identidad de terceros.
• Intentar acceder de forma no autorizada a sistemas o datos de SMCUBA.
• Cualquier conducta que pudiera dañar la reputación o el funcionamiento de la Plataforma.

8. Responsabilidad limitada

SMCUBA no será responsable por daños indirectos, incidentales o consecuentes derivados del uso o imposibilidad de uso del servicio, incluyendo interrupciones de la red de operadores cubanos ajenas a nuestro control.

9. Propiedad intelectual

Todo el contenido de la Plataforma (textos, logotipos, diseño, código) es propiedad de SMCUBA o de sus licenciantes y está protegido por las leyes de propiedad intelectual aplicables.

10. Ley aplicable y jurisdicción

Estos Términos se rigen por las leyes del Estado de Florida, Estados Unidos. Las partes se someten a la jurisdicción de los tribunales competentes de Miami-Dade County para la resolución de cualquier controversia.

11. Modificaciones

SMCUBA puede actualizar estos Términos en cualquier momento. Notificaremos los cambios materiales con al menos 15 días de antelación por correo electrónico o mediante aviso prominente en la Plataforma. El uso continuado del servicio tras la entrada en vigor de los cambios implica su aceptación.

Welcome to SMCUBA. By accessing or using our services, you agree to be bound by these Terms and Conditions. Please read them carefully before making any transaction.

1. Definitions

"SMCUBA" or "Platform": the website smcuba.com and all associated services operated by SMCUBA LLC.

"User": any natural or legal person who accesses the Platform and/or uses its services.

"Top-up": the transfer of balance, minutes, or data to a mobile phone number or Nauta account in Cuba.

2. Scope of Service

SMCUBA facilitates the purchase of mobile top-ups (Cubacel) and internet top-ups (Nauta) for numbers and accounts located in Cuba, on behalf of and at the request of the User.

3. Account Registration and Security

• The User must provide truthful, complete, and up-to-date information during registration.
• It is the User's responsibility to maintain the confidentiality of their access credentials.
• SMCUBA is not liable for unauthorized access resulting from the User's failure to protect their password.

4. Fees and Payments

Prices are displayed in US dollars (USD) and include all applicable charges. SMCUBA reserves the right to modify prices at any time, with changes taking effect upon publication on the Platform.

Payment is processed through the methods accepted on the Platform (Visa, Mastercard, American Express, PayPal). The charge is applied at the time of order confirmation.

5. Service Delivery

Top-ups are processed automatically. The estimated delivery time is under 60 seconds under normal operating conditions. SMCUBA does not guarantee delivery times when delays are attributable to Cuban operators (Cubacel / ETECSA).

6. Refund Policy

• Once a top-up has been successfully processed, cancellations and refunds are not accepted.
• If the top-up did not reach its destination due to reasons attributable to SMCUBA (technical error, double charge, etc.), a full refund will be issued within a maximum of 5 business days.
• To request a refund, contact support@smcuba.com with your order number.

7. Acceptable Use

The use of the Platform for the following is prohibited:

• Fraudulent or illegal activities.
• Providing false information or impersonating third parties.
• Attempting unauthorized access to SMCUBA systems or data.
• Any conduct that could damage the reputation or operation of the Platform.

8. Limitation of Liability

SMCUBA shall not be liable for indirect, incidental, or consequential damages arising from the use or inability to use the service, including interruptions to Cuban operator networks beyond our control.

9. Intellectual Property

All content on the Platform (text, logos, design, code) is the property of SMCUBA or its licensors and is protected by applicable intellectual property laws.

10. Governing Law and Jurisdiction

These Terms are governed by the laws of the State of Florida, United States. The parties submit to the jurisdiction of the competent courts of Miami-Dade County for the resolution of any dispute.

11. Modifications

SMCUBA may update these Terms at any time. We will notify users of material changes at least 15 days in advance by email or via a prominent notice on the Platform. Continued use of the service after the changes take effect constitutes acceptance.
